If there's any possibility of customization, then it's up to the player to decide which set of color to use. Or course if you use brighter color you'll probably be spotted more easily.
Now, here's the thing. The Merc doesn't really see the colors of the spy's goggles from a distance, so the brightness might not even matter at all.

How many times to people have to post that the mercs don't see any color on the spies? They appear 100% black to blend in with shadows. Color customization is for the player's own preference, nothing more, nothing less.

That's pretty much what I'm trying to say. Mercs can only see the spy's color when they're not in the shadows. That's final.

they're not 100% black. more like 5% green or so. shine a flashlight on a spies head and ye can see

Well yeah, but if you are in the dark, you can't see the spy's goggles.  Their green features are more like parts and colors of the spy's body.
