I'm sorry if I'm confusing you. I'm not a law expert but I do know a little bit about intellectual property laws. I do not have the time to lecture you here about IP laws and I suggest you search the internet about that (e.g. Wikipedia).
Here's the answer to your question:
An idea can not be protected, only the expression of an idea. So you can't copy someone's work, but you can copy his ideas. In the case of Splinter Cell that means that we can clone Splinter Cell entirely, as long as we write our own code, make our own graphics and use our own sounds. In other words, we can't steal anything from them except for their ideas.
